Terms & Conditions
These Terms and Conditions constitute a binding agreement between the student and ALZEA India for participating in an internship, study abroad program, study trip, or French Classes arranged by ALZEA India. By agreeing to these terms, the student acknowledges and agrees to the following:
1. Financial Conditions
1.1. Validity of Financial Conditions: The financial conditions outlined in Annexure A remain valid for a period of 12 months from the date of signing this Agreement.
1.2. Refund Policy:
- Unforeseeable Events: Refunds are not provided for any external, uncontrollable events (Force Majeure) beyond ALZEA India’s control.
- Late Withdrawal: No refunds will be granted if the student withdraws after seven days of making the First Payment or after receiving an internship, study abroad program, study trip, or French classes offered, or if they have commenced any online program from ALZEA India.
- Missed Deadlines: Refunds will not be granted if the student fails to submit the required documents within the specified timeline, leading to the cancellation of the internship, study abroad program, study trip, or French classes.
- DREETS Rejection: If DREETS denies approval for the internship, Alzea India may suggest another internship, but we are under no obligation to arrange an alternative internship placement. If the student decides to withdraw from the process at this point, no refund will be provided.
- Premature Termination: No refunds are issued if the student cancels after arriving in the host country.
- Contract Breach: If the student breaches any terms of this Agreement or fails to attend scheduled language classes, or if their language competency is found inadequate, refunds will not be provided.
- Hotel Contract Breach: If the student terminates their contract with the host hotel without ALZEA India’s approval and is required to vacate, no refunds will be issued.
- Relocation: After the student has begun their internship in France, relocation is not permitted unless Alzea India reviews the case and decides otherwise. If Alzea India approves the relocation, an additional fee of 500 euros will apply.
- For French Classes: Once the student registers for Fluentzea French classes, the fee is non-refundable.
- For Study Abroad & Study Trips: Full payment must be made in advance for Study Abroad and Study Trip programs, and payments once made are non-refundable.
1.3. Eligible Refunds:
- First Payment: A refund of the First Payment minus the registration fee is available if the student withdraws within seven days of payment, provided no internship, study abroad program, study trip, or French classes offer has been received and no ALZEA India online programs have been started.
- Visa Rejection: If the student’s visa application is rejected, they are entitled to a 50% refund of the Third Payment.
- Unsuccessful Search: If ALZEA India cannot present a first internship proposal within three months after receiving all necessary documents from the student, and if the search process is halted, the student will receive a full refund.
2. Internship Offer Period
2.1. Acceptance Deadline: Upon receiving an internship offer, the student has four days to accept or reject it. Failure to respond within this period may result in the offer being revoked, and no further offers will be made. Payments made up to this point are forfeited.
2.2. Change Requests: A €200 penalty applies if the student requests a change in internship dates. Postponements after receiving an offer are subject to this penalty.
2.3. Cancellation After DREETS Approval: If the student cancels after DREETS approves the internship agreement, they must pay 50% of the Third Payment and any outstanding amounts owed to ALZEA India.
2.4. Post-Arrival Cancellation: No refunds will be issued if the student cancels after arriving in the host country.
3. Assistance from ALZEA India
3.1. Internship Proposal: Once a confirmed internship proposal is provided, the student cannot request a replacement unless valid reasons are accepted by ALZEA India. ALZEA India will attempt to find an alternative but does not guarantee it.
3.2. Document Submission: The student must sign and return the host hotel agreement and other necessary documents within four days of receipt. Failure to do so may result in the cancellation of the proposal, with ALZEA India reserving the right to restart the search.
3.3. Problem Resolution: Issues during the internship, study abroad program, study trip, or French classes must be reported to ALZEA India immediately. ALZEA India will attempt to resolve them, but if handled independently, any consequences or expenses are the student’s responsibility.
3.4. Accommodation: ALZEA India provides basic accommodation, which may vary in quality and location. The student should not compare their accommodation with others and is responsible for maintaining cleanliness. ALZEA India is not liable for accommodation incidents.
4. Relocation Policy
4.1. Relocation Requests: Relocation requests before the first three weeks are rejected. After this period, valid reasons must be provided for relocation, which ALZEA India may accept or reject. Misconduct or insufficient language competency will void the request.
4.2. Relocation Costs: If approved, relocation is limited to three months, and the student is responsible for all associated costs, including food, accommodation, and travel.
4.3. Relocation Fee: A relocation fee of €500 applies. The student must accept the first available host hotel for relocation without location preference.
4.4. Stipend Withholding: If relocation is requested within the first two months, the host hotel may withhold the student’s stipend.
5. Language Requirements
5.1. Mandatory Language Classes: The student must attend 45 hours of mandatory language classes and pass a proficiency test after two months. Insufficient progress or failure to attend classes will result in termination of the search process.
5.2. Contract Compliance: If the student breaches the host hotel contract without ALZEA India’s approval, they may be required to vacate the accommodation, with no refunds provided.
6. Confidentiality
6.1. Confidential Information: Confidential Information includes any proprietary and confidential information relating to ALZEA India’s intellectual property and business practices, including but not limited to research and development, processes, business plans, financial information, fees, products, services, strategic plans, advertising, marketing plans, and personnel.
6.2. Exceptions: Confidential Information does not include information that: (i) was already known to the student before disclosure by ALZEA India; (ii) becomes publicly available other than through a breach of this Agreement; (iii) is lawfully obtained from a third party; (iv) is independently developed without breach of this Agreement; or (v) is required to be disclosed by law or court order. If legally required to disclose Confidential Information, the student must notify ALZEA India promptly and allow ALZEA India a reasonable opportunity to seek a protective order.
6.3. Protection of Confidential Information: The student agrees to take all necessary steps to keep Confidential Information confidential, including restricting access, not using or disclosing it without ALZEA India’s written consent, and ensuring compliance with applicable laws. The student must protect Confidential Information with at least the same degree of care as their own information, but no less than a reasonable degree of care. Confidentiality extends to the existence and terms of this Agreement.
6.4. Enforcement: Unauthorized disclosure or breach of confidentiality may cause irreparable damage to ALZEA India. ALZEA India is entitled to seek specific performance, injunctive relief, and recovery of legal fees and expenses in case of a breach.
7. Obligations of the Student
7.1. Compliance: The student agrees to comply with all applicable laws, regulations, and the rules of the host organization during the internship, study abroad program, study trip, or French classes.
7.2. Documentation: The student must provide all necessary documentation required for the internship, study abroad program, study trip, or French classes in a timely manner and maintain the accuracy and completeness of such documents.
7.3. Behavior: The student agrees to conduct themselves professionally and ethically at all times during the internship, study abroad program, study trip, or French classes. This includes adhering to the code of conduct of the host organization and ALZEA India.
7.4. Reporting Issues: Any issues or concerns during the internship, study abroad program, study trip, or French classes must be reported to ALZEA India immediately. The student must cooperate with ALZEA India to resolve any issues.
7.5. Language Proficiency: The student must achieve the required level of language proficiency as specified by ALZEA India to participate.
8. Warranties and Covenants
8.1. Warranties: The student warrants that:
- They have provided accurate and truthful information to ALZEA India.
- They have the legal capacity to enter into this Agreement and fulfill its terms.
- They will not breach any other agreements or obligations by entering into this Agreement.
8.2. Covenants: The student covenants that:
- They will not engage in any activities that could harm the reputation or operations of ALZEA India or the host organization.
- They will not use the internship for any purposes other than those specified in this Agreement.
- They will maintain confidentiality as outlined in Section 6 of this Agreement.
9. Governing Law and Dispute Resolution
9.1. Governing Law: This Agreement shall be construed and interpreted in accordance with Indian law.
9.2. Dispute Resolution: The Parties will attempt to resolve disputes through mutual discussion within thirty (30) days of receipt of written notice. If unresolved, disputes may be referred to arbitration.
9.3. Jurisdiction: Disputes are subject to the exclusive jurisdiction of courts in Mumbai.
9.4. Arbitration: Disputes arising under this Agreement will be referred to arbitration in Mumbai, India, in accordance with the Indian Arbitration and Conciliation Act, 1996. The arbitration will be conducted in English by a sole arbitrator appointed by ALZEA India. The arbitral award will be final and binding.
10. Changes to Terms & Conditions
We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms & Conditions.
